Terms and condition These terms and conditions apply to Lenskart Gift Cards (“Gift Cards”) issued by Pine Labs Ltd (“Pine Labs”). Pine labs is a company organized under the laws of India and is the issuer of Gift cards. By purchasing or using a Gift Card, you are agreeing to and accept these terms and conditions. Gift Card Purchase and Redemption: - Gift cards may only be purchased in denominations 1000, 2000, 3000, 5000, 10000. Lenskart Gift Cards can only be redeemed by adding the gift card to the Lenskart Wallet via the app or website. Lenskart Gift cards can be redeemed only on app and website (www.lenskart.com), not accepted on offline stores without addition to lenskart wallet. Once the Gift card is added in the wallet, in case of offline store purchase you can inform the manager to make payment through lenskart wallet where the GC balance is added Gift Card Expiry and Refund: The gift card is valid for 1 year from the date of its purchase. The gift card cannot be exchanged for cash, and no refunds will be provided for any unused balance on the gift card. The gift card validity can be extended, based on request. Gift Card Lost or Stolen: The gift card is the responsibility of the gift card holder, and Lenskart Solution limited and/or Pinelabs is not liable for any unauthorized use of the gift card. Gift Card Terms and Conditions: The gift card is subject to the terms and conditions of Lenskart Solution limited (as the case may be), which may be amended from time to time at their sole discretion. Lenskart/Pinelabs also reserves the right to cancel the GV/GC if the same is purchased with fraudulent means and/or the beneficiary/know-your-customer (KYC) details are found to be incorrect or insufficient as per RBI guidelines. Governing Law and Jurisdiction – These terms and conditions are governed by and construed in accordance with the laws of India. You, Pine Labs and Lenskart Solution limited each agree to submit to the exclusive jurisdiction of the courts at New Delhi. You agree to indemnify Pine Labs and Lenskart Solution limited for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these terms and conditions. Limitation of Liability – NEITHER PINE LABS NOR Lenskart Solution limited MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY WILL BE THE REPLACEMENT OF SUCH GIFT CARD. IF APPLICABLE LAW DOES NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. The Lenskart GV/GC user is deemed the beneficiary. Once activated, the membership cannot be transferred to another user. The GV/GC issued by Lenskart shall be governed by the applicable terms here. The purchaser of Gift Card may add the Gift Card to Lenskart Money balance via Claim option available on Lenskart APP. Multiple Gift Cards can be loaded into Lenskart Money Balance via Claim Option Maximum amount which can be accumulated via Gift cards is INR 1,00,000. The balance uploaded can be redeemed against purchase of any product on Lenskart. GV/GC cannot be used for branded contact lenses, including but not limited to Bausch + Lomb, Johnson & Johnson, Alcon, Freshlook, and Acuvue. Excluded brands may be updated by Lenskart from time to time. GV/GC can only be used for Aqualens contact lenses on Lenskart's website and app. The GV/GC once purchased cannot be canceled, blocked, or returned. The GV/GCs are not for resale nor redeemable for cash. In cases where the Lenskart order is canceled, the GV/GC amount shall be refunded to the source gift card account with its original expiry. Pinelabs/Lenskart is not responsible if the GV/GC is lost, stolen, or used without permission. Lenskart reserves the right to withdraw, modify, cancel, or change the offer at any point without prior notice and at its sole discretion. The purchaser of the GV/GC agrees and understands that the GV/GC is a pre-paid payment instrument subject to regulation by RBI under PPI Master Directions. Under the RBI guidelines, Lenskart may be required to share KYC details of the purchaser of the Gift Card or any other information about the purchase of the GV/GC or transaction undertaken using the GV/GC with RBI or such statutory authorities. Lenskart may contact the purchaser of the Gift Card for any such information. Please refer the Customer Grievance policy for dispute resolution, unauthorized transactions and liability related aspects at https://www.pinelabs.com/grievance-policy/ In the event of any conflict in the terms regarding GV/GC captured here under these Terms and any other terms made available to the purchaser of the GV/GC via Platform, these Terms shall prevail. These terms are governed by the laws in India, all disputes arising out of or in connection to this scheme are subject to the exclusive jurisdiction of the courts in New Delhi only.
